Second hand cigarette smoke is making me sick

“I live in a block of 9 flats. A new tenant moved in two floors below me recently.

He apparently doesn’t work. He sits in the flat and smokes cigarettes all day. The stink and the second hand smoke rises through two floors and into my flat. With all my windows closed it still comes in.

I have headaches and sore throats every day. It is making me sick. This morning I threw up because it was so bad.

My landlord says he can’t do anything. The other tenant’s landlord doesn’t like my landlord so he won’t answer his phone calls.

The building supervisor says the man can do what he wants in his own flat.

Here’s my point: If I turn my television up too loud so he can hear it in his flat, he can complain and I will need to turn it down for disturbing the other residents.

But his smoke making me sick is just something I have to put up with? Or move?

This is not fair!

Is there no tenants rights law that can apply here?

He also lives with his girlfriend and a young girl. If the second hand smoke is this bad two floors up, how is it affecting the health of the child?

Is there no law there to prevent that?”

There is no law protecting you. I spoke to the smokers three floors down. They congregated in the street right under my bedroom balcony. They crossed the road and that was fine for me. I already had bought stink bombs which I would have thrown to disperse them.
