Notification of regulations on smoking in public places

The Department for Environmental Health within the Public Health Regulation Division notifies the public that the following regulations were published in the Government Gazette of the 8th January, 2010 as follows;
Products and Smoking Devices (Stimulating Cigarettes or Tobacco) (Control) Regulations, 2010 – Legal Notice 22 of 2010 and Smoking In Public Places Regulations, 2010 – Legal Notice 23 of 2010.
This Department would like to bring to the attention of interested parties that in terms of the Smoking in Public Places Regulations, no person shall smoke any tobacco product in any enclosed area, however smoking is permissible inside a designated smoking room according to the technical specifications issued by the Malta Standards Authority (DTS 1200 regarding Indoor Air Quality – Reduction of effects of smoking on non-smokers requirements) and such rooms should now be registered with the Superintendent of Public Health prior to their use. Moreover, existing designated smoking rooms in catering establishments need also to be registered with the Superintendent of Public Health within two months from the coming into force of these regulations. It should also be pointed out that the use of such designated smoking rooms is permissible only until 1st January 2013.
Furthermore it should be clarified that products bearing the name cigarette or tobacco, irrespective of whether containing nicotine, for example electronic smoking devices, are to comply with the Products and Smoking Devices (Stimulating Cigarettes or Tobacco) (Control) Regulations, 2010 and should therefore comply with the provisions of the Tobacco Control Act with respect to advertising and smoking in public places.
