Notarial Council issues directive for notaries not to fill in or sign lease registration formThe Notarial Council has issued a directive with “immediate effect” which directs the Notarial College “that the new form for the registration of leases, as issued by Identity Malta, should neither be signed nor filled out by the Notary until further notice.”

The Notarial Council emphasised that “the legal certainty, for which the Notary is the guarantor, must always be ensured.”

Identita had stated last month that as of the 1st of September, any property lease contract submitted with a residence permit application “must be notarised by a Notary, Lawyer, or Legal Procurator. No application will be accepted unless the contract is notarised.”

In response, the Malta Development Association had said that it is of the “firm position that this procedure should be scrapped since it would not be effective in practice.”
