A Xaghra man was today convicted of illegally excavating a quarry extension at Fuq il-Bniet near to San Lawrenz and was fined €100,000 by the court.
The court was told that in April 1998 MEPA had issued a stop and enforcement notice which called on Mr Azzopardi to stop excavating rock from part of the quarry where it was not permitted, however, the excavation continued.
The court also heard that Mr Azzopardi had then proceeded to submit an application to MEPA for the extension of the quarry to be sanctioned, but no permit was issued.
In the hearing Carmel Azzopardi said that he had followed the instructions given by MEPA and disputed the evidence that was given, saying that he was not in charge of the quarry.
Carmel Azzopardi was ordered by the court to refill that part of the quarry which was excavated illegally within three months. Failure to carry out the order would result in a daily fine of €60.
Magistrate Giovanni Grixti heard the case.
